Terms of Service
This English version is a translation provided for reference. If it differs from the Korean version, the Korean version prevails.
Article 1 (Purpose)
These Terms set out the rights and obligations of Leeboom (the “Company”) and centers, and the conditions of use, when a center uses the HAMO service provided by the Company.
Article 2 (Definitions)
- “Service”: HAMO, the exercise and cognitive game service for older adults provided by the Company. It includes the Android and Windows apps, the admin web, and related features.
- “Center”: a senior welfare center, day care center, care facility, or similar organization that has created a center account to use the Service.
- “Center account”: the account, made up of an email address and a password, that a center uses to sign in to the Service.
- “Manager”: the person who creates and manages the center account on behalf of the center.
- “Member (older adult)”: a person whom a center registers in the Service to play games and take measurements together. Members do not create their own accounts.
Article 3 (Posting and Amendment of the Terms)
- The Company posts these Terms on its website (www.hamocare.com/terms).
- The Company may amend these Terms to the extent that it does not violate applicable laws. When it does, it announces the changes and the effective date on the website and in the app at least 7 days in advance, or at least 30 days in advance for changes unfavorable to centers.
- If a center does not agree to the amended Terms, it may stop using the Service and request deletion of its center account.
Article 4 (Center Account Sign-up)
- A center signs up on the center sign-up screen of the HAMO app by entering an email address, a password, the center name, the manager’s name, and the manager’s contact number, and by agreeing to these Terms and to the collection and use of personal information.
- To complete sign-up, the center must enter in the app the 6-digit verification code sent to the email address it entered.
- These Terms apply equally when the Company creates an account for a center.
- A center must enter accurate information, and if the center name or the manager’s information changes, it must notify the Company so that it can be corrected.
- If a center uses another person’s information or enters false information, the Company may refuse the sign-up or later restrict use.
- The manager’s contact number must be a number at which the Company can actually reach the center. If the Company cannot reach the center at that number when it checks, the Company first notifies the center by its email address, and if the center does not correct the contact number within 7 days of that notice, the Company may cancel the sign-up (terminate the service agreement). If the sign-up is canceled, the center account and the center’s records are deleted as described in Article 9.
Article 5 (Obligations of Centers)
- Before registering members, a center must inform the members (or their guardians or legal representatives) of the personal information processed in the Service and obtain any necessary consent. Face recognition login is registered only for members who want it, after obtaining their separate consent.
- A center uses members’ personal information only for the purpose of using the Service, and when a member asks to access, correct, or delete it, the center handles the request without delay or notifies the Company.
- A center keeps the email address and password of its center account secure and does not lend or transfer them to other centers or outside parties. If it learns that its account has been used without permission, it notifies the Company immediately.
- The center is responsible for what is done with its center account, except for matters caused by the Company’s intent or negligence.
- A center uses the Service only in the prescribed ways and does not copy, disassemble, or modify the Service or interfere with its operation.
Article 6 (Provision and Change of the Service)
- Through center accounts, the Company provides features such as exercise and cognitive games, movement measurement, and viewing of records.
- The games and features available may differ from center to center.
- The Company may add or change games and features to improve the Service. Changes that significantly affect use are announced in advance.
- Using the Service requires a device with a camera and an internet connection.
Article 7 (Suspension of the Service)
- The Company may temporarily suspend the Service in unavoidable cases such as inspection or replacement of equipment, failures, communication outages, or natural disasters. If notice could not be given in advance, it is given afterwards.
- If the Company ends the Service, it announces this on the website and in the app at least 30 days before the end date.
Article 8 (Restriction of Use)
The Company may restrict a center’s use of the Service or suspend its center account if any of the following applies.
- The center used another person’s information or entered false information when signing up
- The center registered members’ personal information without their consent or used it for other purposes
- The center lent or transferred its center account to another person
- The center interfered with the operation of the Service or violated the law
Before imposing a restriction, the Company notifies the center of the reason by email. If it must be stopped urgently, the Company restricts use first and notifies the center immediately. A center that disagrees with a restriction may raise an objection by email.
Article 9 (Deletion of Center Accounts)
- A center may request deletion of its center account at any time. In the app, sign in as the center, tap “Log Out” at the bottom left of the first screen, and then tap “Request center account deletion” below the confirmation window. Details are on the center account deletion request page (in Korean).
- After confirming that the person making the request owns the account, the Company deletes the center account and the center’s member information, measurement and game records, and other data. Deleted records cannot be restored.
Article 10 (Protection of Personal Information)
The Company processes the personal information of centers and members in accordance with its Privacy Policy.
Article 11 (Limitation of Liability)
- HAMO is an exercise and play program that helps people move their bodies in an enjoyable way. It is not a medical device and does not diagnose or treat any disease. Measurement results and reports are for reference only and do not replace a doctor’s judgment.
- Centers run the Service while watching members’ physical condition so that they do not overexert themselves.
- The Company is not liable for damage for which it bears no intent or negligence, such as damage caused by force majeure such as natural disasters, by a center’s careless account management, or by information a center entered incorrectly.
Article 12 (Dispute Resolution and Jurisdiction)
- If a dispute arises, the Company and the center first consult in good faith.
- These Terms are governed by the laws of the Republic of Korea.
- Lawsuits not resolved through consultation are handled by the competent court under the Civil Procedure Act of the Republic of Korea.
